Enrollment Agreement

This Course Enrollment Agreement (this "Agreement") is between High Performance Learning, LLC, dba AoPS Academy ("AoPS Academy") and you (the "Parent" or "you"), in connection with the enrollment of your child as a student in an AoPS Academy program ("Program"). You represent and warrant that you are the parent or legal guardian of the student, or that you are otherwise acting as the agent of the student's parent or legal guardian and are fully authorized to enter into this Agreement on behalf of the student's parent or legal guardian.

You agree that the identification, emergency contact, phone number, and address that you have provided about you and your student are accurate, and that you will keep that information up to date on our website if there are any changes while your student is enrolled at AoPS Academy.

You agree that you will escort your child into and out of the building for all visits to AoPS Academy, including classes. AoPS Academy does not assume responsibility for children dropped off in the parking lot or anywhere else outside of our building.

You agree that in an emergency situation, AoPS Academy may contact the people you have identified as emergency contacts. In case of a medical emergency, AoPS Academy will seek to contact the parent/guardian and emergency contacts. However, if they cannot be reached or if time is of the essence, you authorize the Program to seek emergency medical assistance. You authorize the Program designee to consent to any x-ray, examination, anesthetic, medical or surgical diagnosis, treatment, and/or hospital care to be rendered upon the advice of any licensed physician and/or dentist.

All Program fees are due in advance. There will be no refund or pro-rating for holidays, family vacation, illness, or absences. Disruptive and disrespectful behavior will not be tolerated and may in AoPS Academy's sole judgment be cause for dismissal from the Program.

You agree that AoPS Academy provides internet access to students as part of the learning environment during some of our classes. Students must adhere to acceptable behavior expectations while using internet during class. Students are only to use devices and access the internet when granted permission to do so by their teachers. They are to use devices and internet access educationally as instructed by their teachers and for no other reason. You agree that students who violate this administrative rule may be subject to disciplinary action.

You agree to release and hold harmless AoPS Academy, its successors, teachers, officials, officers, agents, employees, and volunteers, from and against any and all liability, damage or claim of any nature arising out of or in any way related to my child’s participation in the Program, except for damages caused by the gross negligence or misconduct of AoPS Academy. You understand that AoPS Academy does not provide accident or medical insurance and you are financially responsible for any and all medical and other expenses whatsoever. AoPS Academy is not responsible for students' personal items.

You understand that AoPS Academy may send you information about additional products and services provided by AoPS Academy, High Performance Learning, or AoPS Incorporated (the parent company of High Performance Learning). You will have the option to opt out of receiving these emails on your account page and via links in these emails.

You grant to AoPS Academy the right to photograph and record (both video and audio) you and your child. Classroom and facility recordings are used for training, quality assurance, and safety purposes and will not be distributed to third parties. You release AoPS Academy from any claims whatsoever relating to the aforementioned rights you have granted to AoPS Academy regarding photography and recording (both video and audio).

If your student attends an on-campus event, photos may be taken during the event. By enrolling your student in an AoPS Academy Program and attending an on-campus event, you hereby consent to use of photos taken of your student during the event by AoPS Incorporated (“AoPS”) and its subsidiaries, affiliates, successors, and assigns for purposes of advertising and/or trade in any and all media, throughout the world in perpetuity, without restriction as to frequency or duration of usage. AoPS is authorized to edit, alter, copy, exhibit, publish, or distribute photos for purposes which shall include, but are not limited to printed and digital publications, bulletins, videotapes, reprints, reproductions, advertisements, and any promotional or educational materials in any medium now known or later developed, including the Internet. You hereby waive the right to inspect or approve the finished product, including written or electronic copy wherein your student appears, as well as any claim, for yourself and for your student, of royalty, right, remuneration or compensation in any form for said use.

You understand that you and your student have no right, title, or interest to any materials, and that AoPS shall have a license in perpetuity to use any and all materials (and all rights therein, including the copyright) produced pursuant to this agreement. You further agree, subject to the provisions above, that AoPS may use your student photo in any manner. You hereby release AoPS, its parents, subsidiaries, franchises, assigns, employees, shareholders, officers, directors, and authorized agents from any and all claims which arise out of or are in any way connected with such use.

If your student is taking a science class, you agree to the terms of the AoPS Academy Science Safety Policy, available here.

If your student takes video-based classes, you agree that you and your student will not create video, audio, or image recordings of the class. You also agree that you and your student will not share the system-created recordings provided on the course page with any third party.
